Should Uniform Civil Code Be Implemented in India?

The implementation of Uniform Civil Code in India has been an issue of debate for a long time. Before every general election, this matter becomes a hot topic for discussion. The ruling government is in support of the Uniform Civil Code. It is necessary to know about Uniform Civil Code.

A Uniform Civil Code basically about unifying all personal laws under one single set of secular laws for every citizen of the country, irrespective of the community or religion they belong to. The exact guidelines of the Uniform Civil Code are not disclosed, it should presumably have the most progressive and modern elements of all the personal laws, dumping those which are conservative. Agree
• The execution of the Uniform Civil Code will promote secularism. As now India has selective secularism which means that in some parts of the country people are secular but in other parts of the country, people are not. There is the absence of uniformity. Uniform Civil Code will prompt all the Indian Citizens to follow same laws. At the same time, it will not restrict the freedom of the people to pursue the religion.
• The laws will be helpful in bridging the existing gaps. As for Muslims have the freedom to have more than one wife in India. Also, the unwed Christian mother cannot have the guardianship of the child without the consent of the father. The personal laws differ in terms of inheritance, family, and other terms.
• The main motive behind the implementation of the Uniform Civil Code is to provide rights and dignity to women in Indian society which is extremely misogynistic, and patriarchal as it allows conventional rules to exist to rule the family. As a result, Indian women are still subject to mistreatment and subjugation.


Disagree
• The different set of uniform rules that breach the religious laws are imposed upon people which would go against the fundamental rights of freedom stated under Article 25 of the Indian Constitution.
• Protection of human rights or social obligations is concerned; the nation has laid bottom line policies through general laws. Example-The law regarding Child marriage and reigns over all personal laws.
• Another such law Section 125 of CrPC which provide an arrangement of which courts can pass orders for maintenance of parents, wives and children, under criminal, irrespective of the religious status.


Conclusion
There is need to change all the conventional laws that restrict one part of the society or the other one. Instead of external regulation, the changes should come from the communities. It would serve as a better cover of the social fabric of India. Even if new Uniform Civil Code is designed, it should consider the major personal factors pertaining to all Indians. The decision should not be driven by partisan or of different religious consideration.
